Starting a new life together in a different country: this scenario is full of promise, excitement and new beginnings. However, sometimes things just don’t work out. Spouses separate for many reasons: they may just grow apart, or those from overseas may just miss home too much.
If you’ve come to the UK from outside the EU to get married or be with your spouse and your visa is dependent on that marriage, if you do end up getting divorced, that visa will end. You may need to go through the application process again once your divorce has been made final.

There are different options available. If you want to stay in the UK, you can apply for your own visa. You will need to inform the Home Office that you and your partner have divorced and you can then check if you have the right to remain in the UK independently. If you’ve been in the UK for 10 years or more, there’s a high chance you’ll be given indefinite leave to remain (a permanent visa). If you are under 65 you will need to pass a Life in the UK and English language skills test.
Another option you could take is the parent route, which you are eligible for if you have children who live in the UK. Another is you can apply for a work visa. You’ll need to be sponsored by your employer and your occupation will need to be on the shortage occupation list.
