Divorce: what you need to know

No one wants the hopes and dreams of their marriage to end in divorce, and hopefully it’s something that you will only have to go through once, if at all.

If your marriage has come to the point of breakdown, it’s likely that you aren’t going to be an expert in how to go through divorce proceedings. At this emotional and challenging time, what you need is an expert to guide you through, such as Saracens Solicitors.

We find that couples without children to consider have two main questions: how do I start the process and how do we work out the finances and assets?

Our experienced divorce solicitor in London can guide you through this unfamiliar terrain and answer all the questions you have along the way.

How does it work?

Your first point of call to dissolve your marriage is a divorce solicitor in London. Contrary to popular belief, the actual divorce proceedings don’t take that long. It can take as little as 4-6 months. As your divorce solicitor in London, our job is to take care of the legal and administrative side of things. This means that you can focus on the emotional and practical issues.

In England, sadly there is not yet no-blame divorce. To be granted a decree nisi, you need to identify one of these five reasons for the marriage ending:

  • Adultery
  • Unreasonable or intolerable behaviour
  • Desertion for at least two years
  • Separation for at least two years with intention to divorce
  • Separation for more than five years.

When this has been identified, a divorce petition is filed, and the court can issue a decree absolute, which brings the marriage contract to an end.

Dividing up finances and assets is a vital part of our work as your divorce solicitor in London. The final financial settlement takes one of these forms:

  • Maintenance
  • Lump sum
  • Property adjustment
  • Pension order.

Ideally, we’ll work this out outside of court. If that doesn’t work out, our divorce accountancy partners will petition the court for the best possible financial settlement for you. With their expert knowledge, and our legal acumen, we have a great record in this area.
