Wrongful Termination.

Unfair dismissal occurs when an employer dismisses an employee without providing a fair reason for doing so and without following a fair procedure. Claims of unfair dismissal can be expensive to defend and even more costly if the tribunal decides in favour of the employee. Our specialist employment team will conduct a thorough assessment of the circumstances surrounding (or leading up to) the dismissal with a view to ascertaining whether the dismissal would be considered unfair. Our team will then advise you on the best course to action to take, strategically, taking into consideration both commercial and financial factors.

If you have been dismissed and believe that your dismissal was unfair, it can be an incredibly unsettling time.

If you find yourself in the precarious position of not having any money coming in, the last thing on your mind would be to instruct a solicitor to act on your behalf. Being concerned about the costs of instructing a solicitor is completely understandable. However, at Saracens, we are sensitive to your concerns regarding costs, and we will endeavour to find a funding option to suit your particular circumstances. We will be able to provide you with information whereby you can decide how you would like to fund your claim. Indeed, many people are unaware that funding their claim at a Tribunal can be surprisingly inexpensive.

Furthermore, if your employer deviates from the ACAS Code of Practice, not only could you be entitled to compensation but also an uplift to your compensatory award, at the Tribunal’s discretion.

Our specialist employment department can provide you with advice regarding your claim for unfair dismissal and can advise you as to your chances of success, the compensation that could be awarded to you and can assist you in proceeding to the Employment Tribunal.

An employer can only dismiss an employee for a fair reason and provided that it follows a fair procedure. If your employer did not have a fair reason and/or if they did not follow a fair procedure, it is likely that you may have a claim for Unfair Dismissal.
