Discrimination.

Employees can face discrimination in the workplace. Discrimination exists in many forms. The Equality Act 2010 protects employees from discrimination in the workplace. If you find that you are discriminated against at work as a result of your age, gender, sex, race, religion, sexual orientation or for any other reason, our specialised team will advise you on your potential claim and represent you in any Tribunal proceedings.

If you are refused a job, or are dismissed, or are treated less favourably by an employer because of characteristics such as your race, sex, gender reassignment, marriage/civil partnership, religion or belief, age, disability, sexual orientation etc, it can be extremely upsetting and humiliating experience. The Equality Act 2010 offers all employees significant protection from discrimination and also offers protection from reprisals against employees if they complain of discrimination in the workplace. Employees are also protected from direct and indirect discrimination as well as discriminatory harassment.

The Equality Act also brought into effect a prohibition against discriminating against people based on the employer’s perception of them, for example, if you are discriminated against because your employer believes you to be of a certain race when in fact you are not. Furthermore, there is now a prohibition against discriminating against someone based on their association with people, such as disability discrimination against someone who is not disabled but is a carer for someone who is.

Discrimination is an extremely complex area of employment law with tight deadlines by which to make a claim at the Tribunal, so it is extremely important that you seek legal advice as soon as possible if you believe you have been discriminated against.
